Terms of Service

By accessing or using the StreamScry platform ("Service"), operated by StreamScry, Inc. ("StreamScry", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not access or use the Service.

StreamScry provides an AI-powered livestream monitoring platform that enables brands and their partners to monitor streaming content for compliance, brand safety, and campaign performance. The Service includes real-time detection of violations, evidence capture, reporting, and campaign management tools.

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at legal@streamscry.com of any unauthorized use of your account. StreamScry is not liable for any loss resulting from unauthorized access to your account.

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Monitor content without the necessary rights or permissions to do so.
• Upload or transmit malicious code, viruses, or harmful data.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse engineer, decompile, or extract source code from the Service.
• Resell, sublicense, or otherwise transfer access to the Service to third parties without our written consent.
• Use the Service in a way that could damage, disable, or impair it.

StreamScry and its licensors retain all intellectual property rights in the Service, including the platform, software, AI models, and documentation. These Terms do not grant you any ownership rights in the Service.

You retain ownership of all content you submit to the Service (campaign briefs, stream data, etc.). By submitting content, you grant StreamScry a limited license to process and analyze that content solely to provide the Service to you.

Each party agrees to keep the other's confidential information confidential and not to disclose it to third parties without prior written consent. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

Access to certain features of the Service may require a paid subscription. Subscription fees are billed in advance on a recurring basis. You authorize StreamScry to charge your payment method for all applicable fees.

All fees are non-refundable except as required by applicable law or as otherwise stated in a separate agreement. StreamScry reserves the right to change pricing with reasonable advance notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. STREAMSCRY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED DETECTIONS WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMSCRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL STREAMSCRY'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS PAID BY YOU TO STREAMSCRY IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless StreamScry and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms remain in effect while you use the Service. StreamScry may suspend or terminate your access at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 9, and 10 survive termination.

StreamScry reserves the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice within the Service. Your continued use of the Service after the effective date of updated Terms constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
